What you can expect from us

Our Platform is created for legal entities and individual entrepreneurs who are looking for business contacts — people and companies matching a profile they define.

Our Platform provides search and matching functionality which is empowered by machine-learning.

As a user of our Platform you can:

• describe, in your own words, the kind of person or company you want to find
• receive a batch of matching leads, together with an explanation of why each one matches the profile you described
• review, approve or reject each lead before doing anything with it
• obtain available contact details for the leads you approved, and import your own lists
• connect your own mailbox or LinkedIn account and run outreach sequences from it, and see the replies to those conversations in one place

Our Platform has no public, contact-facing side: the people we surface to you are not our users, do not have accounts with us, and are not notified by us. Everything sent to them is sent by you, from your own account, on your own initiative.

Our Company is not directly involved in, and is not an agent or party to, any transaction, engagement or relationship that may result between you and any lead or organization you contacted through our Platform.

Although we make reasonable efforts to update the information on our Platform, we make no representations, warranties or guarantees, whether expressed or implied, that the information on our Platform is accurate, complete or up-to-date. Matching is a prediction, not a verified fact, and you are responsible for verifying anything you act on.

What we expect from you

• You must have all necessary authority to act on behalf of company you represent.
• You must be at least 18 years old.
• You must follow these basic rules of conduct:
  • Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, human trafficking laws.
  • Respect the rights of others, including privacy and intellectual property rights.
  • Don't abuse or harm others or yourself (or threaten or encourage such abuse or harm) — for example, by misleading, defrauding, defaming, bullying, harassing, or stalking others.
  • Don't abuse, harm, interfere with, or disrupt the services.
• You have no obligation to provide any information to us, but if you do so, then:
  • You warrant that you have obtained the necessary rights and consents and that the content is accurate and lawful.
  • You must maintain and in due time update the information to keep it true, accurate, current and complete.

• When you use our Platform to contact people, you are the sender. You are responsible for the content of your messages and for complying with the rules that apply to outreach — including, without limitation, the CAN-SPAM Act, applicable anti-spam and electronic marketing laws, and the terms of the mailbox or social network you connected. You must honor opt-out and unsubscribe requests, and you must not use our Platform to send unlawful, deceptive, or harassing messages.
• You agree to keep confidential all information obtained about leads through the use of our Platform (including but not limited to their personal information), together with all other confidential information relating to our business. You shall:
  • Not disclose the Confidential Information to any person other than your employees who have a reasonable need to know the information in connection with the business purpose for which you obtained it, and provided such employees undertake to observe the terms of this confidentiality clause.
  • To protect the Confidential Information from loss, misuse, unauthorized access, disclosure, alteration or destruction. If requested by us, you shall immediately return or destroy (as directed by us) all documents and material containing or referring to the Confidential Information.
• You agree that for the purposes of applicable data protection legislation including but not limited to the Data Protection Act 2018 and the General Data Protection Regulation 2016/679 or similar laws (the "Data Protection Legislation") we are a data controller and you are a data controller in respect of any personal data that you obtain about leads through the use of our Platform. As a controller of that data you are responsible for having a lawful basis to process it and for meeting the information obligations you owe to the people it describes.
• You are also responsible for ensuring that all persons who access our Platform through your internet connection are aware of these Terms & Conditions, and that they comply with them.
• We retain any intellectual property rights that we have in our content. You may not copy, modify, distribute, sell, or lease any part of our content without our written permission. You may not resell, redistribute, or make available to third parties the lead data obtained through our Platform as a data product of your own.
• You'll indemnify our Company and its directors, officers, employees, and contractors for any third-party legal proceedings (including actions by government authorities) arising out of or relating to your unlawful use of our services or violation of these Terms & Conditions.
• Our Company won't be responsible for the following liabilities: loss of profit, revenue, business opportunities, goodwill, or anticipated savings, indirect or consequential loss, punitive damages.

When we can restrict your access to our Platform or delete your account

We reserve the right to suspend your access to our Platform or delete your account if we reasonably believe that you breach these Terms & Conditions or violate applicable law, or you could harm our users, the people you contact, us, or third parties.

When reasonably possible, we will provide you with advance notice prior to suspending access or deleting your account, describing the reason for our action, and providing you with an opportunity to fix the problem, unless we reasonably believe that it could cause harm to us, to other users, or to third parties; violate the law or legal enforcement order; compromise investigation; or compromise the operation, integrity, or security of the services.

Governing law and jurisdiction

These Terms & Conditions and your relationship with our Company under these Terms & Conditions are governed by the laws of the State of California, United States, excluding conflict of laws rules.

Any disputes shall be referred to and finally resolved by the state and federal courts located in California in its exclusive jurisdiction.

Severability and change

If any particular term of these Terms & Conditions is not valid or enforceable, this will not affect any other term.

If you don't follow these Terms & Conditions and we don't take action right away, that doesn't mean we're giving up any rights that we may have, such as taking action in the future.

We may update these Terms & Conditions from time to time.

If we materially change these Terms & Conditions we'll provide you, when it is reasonably possible, with advance notice.

If you continue to use our services after we publish or send a notice about changes to these Terms & Conditions or Privacy Policy as a part of them, it means that you agree with these changes.

If you don't agree to the new terms, you should delete your account and stop using the services.
